Scalia's daughter popped for DUI, endangering children in Wheaton

Hmmm. I wonder how many motions her lawyer will file that her dad would love to strike down?
Supreme Court Justice Antonin Scalia’s daughter was arrested on drunken driving charges Monday night in Wheaton, police said.

Ann S. Banaszewski, a Wheaton resident, was arrested Monday around 7:30 p.m. at the intersection of Gamon Road and Longfellow Drive after someone reported seeing a possible drunken driver near the McDonald’s at 2030 S. Naperville Road, according to a police press release.

Banaszewski’s three children were also in the car, a 1996 Ford Ecoline van. At her request, the children were dropped off by police at a family friend’s home, Wheaton Deputy Police Chief Tom Meloni said.

In addition to the drunken driving charge, Banaszewski was charged with endangering the life of a child. She was processed on both charges at the Wheaton Police Department and was released on a recognizance bond.

Meloni would not reveal the children’s age, but said all three were under 17 years.

The Smoking Gun has her mug shot and the police press release.

It's sad that she chose to do this with children in the car.

However, depending on the details of her arrest, you can expect her attorney to request that the charges be dismissed as the police didn't have sufficient evidence to pull her over.

If all they had was a tip from a citizen than that is insufficient grounds to make a stop.

True enough MDA....

But surely a citizen tip would be considered probably cause, would it not? I would think that's all the legal grounds a cop would need to pull someone over.

Regardless, 7pm drunk? She is pretty hard looking for mid forties. If you had that guy for dad, you would be suppressing your childhood somehow.

For some reason, I would conclude her dad will do nothing to held her.

Milton, I agree on all your points. I imagine we'd all be drinking early if we had Fat Tony for a father.

When you're 45 years old, the statute of limitations for blaming your parents for your shortcomings has expired.

Nic,

It was 7pm and she was taking her kids somewhere. This was the housewife/ Mother. It was not like the 3am clubbing photos we are used to seeing.

Kind of sad, regardless.

Shame on all of you for pretending to know her, her life, her upbringing -

ever heard of the 'glass house' theory?

Relax a little and let people deal with their lives.

I appreciate your call for compassion, but somehow I don't think your glass houses argument would stand up. I'd put better than even money on the fact that no readers have ever been popped for DUI in the middle of the afternoon with their kids in the car.

Maybe I'm wrong.... but I doubt it.

Maybe not 'pooped with a DUI', but if you think that your readers have never driven a car with a couple of drinks under their belt - and kids in the car, you either have a bunch of ultra-right wing, bible thumping church goers in your audience - or you are (once again) sadly mistaken.

And let's be honest, with your antagonism towards faith, I think that it is not the former...

I stand by my assertion that none of my readers have driven drunk with their children in the car.

And your attempt to warp my views is dead wrong as well. I don't have any "antagonism" towards faith.

Just jerks who warp and distort Christianity to acheive right wing goals or who attempt to pervert Jesus' message in order to spread intolerance and division.

Faith? I got no problem with that.

And if you think for one moment that "bible thumping church goers" never get drunk.... think again.

From past experience, they might be the ones driving around with a gay prostitute while high on meth.
